As we are currently pre-production, we are inviting you to reserve a priority place in line to purchase the Sunflower Home Awareness System when it becomes available. Priority will be assigned based upon the time we receive a completed pre-order. In order to complete your pre-order, you must have complete the Pre-Order Form and submit payment of US$999 as a refundable deposit to secure your place on our priority list. We will contact each priority customer on our reservation list when we approach the date on which the Sunflowers will be ready to ship to enable them to complete their order and purchase their Sunflowers.
We may from time to time publish an expected availability date for the Sunflowers. Please understand that such a date is our best estimate, but we cannot guarantee we will be able to start shipping on that date. The schedule may change due to events that were unforeseen at the time of our estimate. You may cancel your pre-order, or request a change in your pre-order, at any time prior to completing your order by contacting our customer support team. While we will honor a request to cancel a pre-order, our ability to fulfill a requested change to a pre-order may depend upon the request (e.g., we may be unable to increase the number of Sunflowers in your pre-order).
We hope to spread the news of our products by referrals. If you submit a reservation to purchase Sunflowers, the email you receive confirming your reservation will include a referral code. You may provide your referral code to as many people you know as you like, and for each person who purchases our Sunflowers using your referral code, we will provide you a $20 credit that will reduce the purchase price of your initial Sunflowers purchase, up to a maximum credit of $200. You may be required to pay any applicable sales tax, VAT, GST or similar taxes and other charges based upon the purchase price of Sunflowers prior to the reduction for your referral credits.
Referral codes should only be shared with your personal connections that will appreciate receiving these invitations. Referral codes should not be published or distributed where there is no reasonable basis for believing that all or most of the recipients are personal acquaintances (such as by social media, coupon websites, etc.).
Credit you earn by sharing your referral code is only eligible for your initial purchase of the Sunflowers, and must be used within one calendar year from the date on which you earn the credit or they will expire without any value. Credits may not be transferred to anyone or exchanged for any money or other consideration.
We may suspend or terminate this referral program at any time and for any reason, but except as follows we will honor previously awarded credits. We reserve the right to investigate all referral activities and to modify to terminate referral credits if we determine they are associated with any abusive or fraudulent behavior, or you have violated these Commercial Terms, as we deem to be fair and appropriate.
When you elect to purchase a product from us and enter a form of payment, you agree that: (i) you will fulfill your obligation to pay for the product by the date on which payment is due; (ii) any payment information you provide is true and accurate; (iii) you are authorized to use the payment method you provide; (iv) we have permission to retain the payment information and method, including all submitted debit and credit card information, submitted by you and your issuing bank or the applicable payment network; and (v) we are authorized to charge you for the product using the established payment method. Your assurances of payment and our rights to collect payment include any obligation you may have to pay any taxes or delivery charges described as being applicable to the product you are buying. In addition, you agree that you will be responsible for any credit card chargeback fees as well as any reasonable collection costs we incur as a result of your failure to pay on a timely basis.
You agree to pay the charges for the product in the currency specified by Sunflower Labs (or any payment processor from which you may purchase the product) when you submit your order, and you assume all risks associated with any changing value in the currency compared with other currencies. The specified charge for a product may include certain taxes and delivery or similar charges applicable to your purchase. If any tax or charge applicable to a purchase is not charged by us, you acknowledge that you are solely responsible for paying the tax or other charge, such as any charge for a cash on delivery purchase, if available.
Our prices for a product do not include any of the third-party fees you incur in connection with using the product including, without limitation, fees charged by your Internet access provider, any wireless carrier charges for cellular or data services and any other third party applications or services with which you may use the product; you are responsible for selecting and managing these other services, and paying the fees for such services.
Sunflower Labs may, in our sole discretion, agree to permit you to pay us for products pursuant to invoices issued by Sunflower Labs. Unless otherwise expressly provided in our invoice, we will issue our invoice on or shortly after the date on which the product is purchased, and the charges are payable upon your receipt of the invoice. All payments of invoiced amounts must be made in the currency specified on the invoice by check, wire or other electronic transfer to a bank and account number designated by Sunflower Labs. Any invoice that remains unpaid thirty (30) days after the invoice date is considered delinquent. Any wire transfer fees or other similar fees incurred on account of the payment method selected by you are your responsibility and may not be deducted from the amount due Sunflower Labs.
When you order a product, Sunflower Labs will confirm your order via email to the email address you provide with your order. This does not mean that your order has been accepted or shipped, however. As part of our shipping procedures, we verify the availability of an item for you before we accept your order. If the item is no longer available, not permitted to be sold in your area or if we determine that there were inaccuracies in our product information, including incorrect pricing or availability information, we may cancel your order and notify you of such cancellation via email. We will not charge you until after your ordered product has entered the shipping process.
Any product you purchase will ship as it becomes available. Sunflower Labs charges reasonable fees that are intended to cover the costs of delivering your purchase. While we try to ensure that only the most reliable delivery services are used, the actual delivery of your order can be impacted by many events beyond our control once your purchase leaves our facilities. We will generally provide you information so that you can track your package, and we will work with you to ensure a smooth delivery. We also use care in selecting carriers so that the product you order arrives safely. If you believe a shipment may be delayed or you receive a product and feel it is damaged or not operating properly, please contact our customer support team to report the problem immediately. Please be aware that all purchases are subject to Sunflower Labs’ Return Policy.
Please note that products are subject to the customs and export control laws of the United States and may be subject to customs laws and regulations of the country in which you reside. By purchasing a product, you agree to abide by the customs and export control laws applicable to that product, including but not limited to the U.S. Export Administration Act and the Arms Export Control Act, and you agree that you will not transfer a product to a foreign national or foreign destination in violation of the law. Also, please note that not all products are available in all geographic locations.
To return a product purchased from us you must first contact our customer support team in order to determine if your product is eligible for a return or exchange and, when applicable, to obtain a return shipping label. All returns must have a Sunflower Labs - provided shipping label and be returned within six weeks from the date you receive such shipping label.
If you contact our Customer Service within 30 days of receiving the product and our Customer Service team determines that the delivered products were not what you ordered, were delivered to you damaged or otherwise not conforming to their applicable warranty, then you will be eligible for a refund or replacement of such product.
We will permit you to return products for a refund if you contact us within 14 days of your receipt of the products. The products must be unused and returned in their original packaging with all tags or labels intact. We will issue you a refund of the purchase price, reduced by any applicable shipping and handling fees, following our processing of your return. Products that are marked “Final Sale” are specially priced and not eligible to be returned or exchanged.
We’ve worked to describe our products as accurately as possible, but we realize that, on occasion, product pictures or descriptions may not be perfect. Accordingly, Sunflower Labs cannot assure you that the product images and descriptions are 100% accurate, complete, current or error-free.
We will do our best to ensure that you are satisfied with the product you purchase so, if you feel that a product shown is not accurately described, and you want to obtain a refund or exchange, please contact our customer support team within 14 days of your receipt of the item for assistance; otherwise, you will be considered to have accepted the product.
Sunflower Labs may, in our sole discretion, enable you to purchase and/or pay for certain products through a payment processing firm. Your obligation for payment to, and relationship with, such payment processor is a contractual matter between you and such third-party; Sunflower Labs is not a party to, or responsible on account of, such contract. While we select our payment processors carefully and enter into detailed agreements imposing performance obligations (including confidentiality) on them, we cannot and do not guaranty their performance. We encourage you to provide any feedback regarding any payment processor with which you do business to us, as we value and use your input in determining whether to continue or end such relationships. If you have any concerns or problems with a payment processor, please contact our customer support team as promptly as you can. And, if you seek information about any party acting as a payment processor before you enter into any agreement with them, please feel free to contact our Customer Support team.
In addition to the published price of a product, you agree to pay any reasonable costs we incur to collect any unpaid or past due amounts, including reasonable attorneys' fees and other associated costs. Delinquent payments will bear interest at the rate of 1% per month or the highest rate permitted under applicable law, whichever is less, from the payment due date until paid in full.
We may update these Commercial Terms from time to time. The Commercial Terms published on our site at the time you reserve, pre-order, order or purchase a product will apply to your transaction. Please be sure to review these Commercial Terms before you finalize any transaction. If you do not agree to the then-applicable Commercial Terms, you may elect not to enter into the transaction.
